W-8BEN for Upwork & Freelancers
Generate your W-8BEN for freelance income in minutes
If you work with Upwork or international clients and live outside the US, you may need a W-8BEN form. Our tool helps you generate a completed, ready-to-submit form tailored to your case.

Why freelancers are asked for W-8BEN
US companies and platforms that pay people outside the United States often need tax documentation before they send money. Form W-8BEN is the standard way for an individual to certify that you are not a US taxpayer and, when it applies, to claim a reduced rate of withholding under a tax treaty.
If you do not provide a valid form when it is required, the payer may apply default withholding rules. In some situations that can mean withholding up to 30% until proper documentation is on file.
Completing W-8BEN helps confirm your foreign status and, when you qualify, supports claiming treaty benefits so the correct rate applies to your payments.

What type of income is freelance income?
Freelance payments from platforms like Upwork or Fiverr, and fees from direct clients, are usually treated as payment for services or business-like income—not wages from a US employer.
Under many US tax treaties, that kind of income is often considered under the “business profits” rules (for example, Article 7 in many treaties). The exact article and rate depend on your country of residence and whether you have a taxable presence in the United States.
If you have an office, employees, or other business operations in the US, treaty benefits may be limited. Our wizard helps you describe your situation in plain language—confirm specifics with a tax professional if you are unsure.
Worked example: a UK freelance graphic designer on Upwork
Amelia Reeves takes on branding and packaging design jobs through Upwork from her home studio in Leeds. Without a valid W-8BEN, Upwork withheld the default 30% on payments classified as US-source income—£540 held back from a £1,800 month before the rest reached her account.
After filing a W-8BEN, listing the UK as her country of tax residence, and citing Article 7 (business profits, no US permanent establishment), Upwork now applies 0% US withholding on the same payments. Her UK tax position doesn't change—this only removes the US withholding layer.
- Without W-8BEN: 30% withheld at source—£540 on a £1,800 month.
- With W-8BEN + Part II (UK, Article 7): 0% US withholding—the full £1,800 reaches her account, still reportable to HMRC as normal.

What this means for your Self Assessment in the UK
A W-8BEN only affects US withholding—it does not exempt you from UK tax. Upwork earnings are normally reported to HMRC through Self Assessment as self-employment income, whether or not the US withheld anything.
Services billed to a client outside the UK (Upwork's payments are typically treated this way for VAT purposes) usually fall outside the scope of UK VAT under the general B2B place-of-supply rule—but you may still need your own VAT registration once your turnover crosses the threshold. Confirm your registration status and thresholds with an accountant, since figures change.
- Keep your Upwork tax confirmation and any Form 1042-S you receive.
- Report Upwork income through Self Assessment, independent of US withholding.
- Check the VAT registration threshold as your freelance income grows.

Freelance W-8BEN FAQ
Do freelancers need a W-8BEN?
Many non-US freelancers are asked for tax documentation when a US company or platform pays them. For individuals, that is often Form W-8BEN. Follow the instructions in your Upwork, client, or payment account.
Does Upwork require W-8BEN?
Upwork may ask you to complete tax information in your account. Requirements can depend on your country and payment method. Use the prompts in your Upwork settings and official help articles for the latest steps.
What tax rate applies to freelance income?
It depends on your country of tax residence, the type of income, and whether a treaty reduces withholding. Rates are not the same for everyone. W-8BEN is how you claim a treaty rate when you are eligible.
Is freelance income US-sourced?
Sourcing rules can be complex and depend on facts—where the work is performed, who the payer is, and how payments are classified. Your form helps the payer apply the rules they use for withholding. Ask a tax professional for your specific case.
Can I avoid US tax as a non-US freelancer?
W-8BEN is not a “trick” to avoid tax. It helps payers apply the correct withholding when you are a foreign person and, when applicable, claim treaty benefits. You may still have tax obligations in your home country.
Do I need an ITIN?
Not everyone needs an ITIN or SSN to complete W-8BEN. Some treaty claims can be made with a foreign tax identification number. The IRS form instructions explain what applies to you.
